Overview

Step Up Tutoring (“Company”, “we”, or “us”) is a nonprofit organization providing free online tutoring for subjects such as math and English to students in kindergarten through 12th grade. This Privacy Policy describes the practices of Company and applies to the products and services provided by Company (the “Services”), including this website (the “Site”).

 

Information We Collect

Information You Provide to Us. On our Site, we collect information you provide in your use of our Services.  When you apply for or otherwise interact with our Services, you may be invited to provide personal information, such as:

  • Identifiers (such as name, email address, physical address, telephone number, student’s name, student’s email address, student’s grade level and teacher)

  • Education history

  • Professional or employment-related information

  • Other information you provide us, including student classwork. 

Information Collected Automatically.  We collect information about your use of our Services, including device information (IP address, device identifiers, settings, and operating system) and internet or other electronic network activity information (such as information about the time and duration of your use of the Services, interaction with content, and information stored in cookies or similar technologies).  For more information about our use of these technologies, see Cookies.

Information from Schools and Third Party Partners.  We also may receive information from our partners who are involved in providing the Services to you.  If you participate in the Services through our partnership with a school, school district, or other educational institution (“School”), we may receive information from the School about you.  

How We Use Information We Collect

  • To Provide and Manage the Services You Request.  This includes, for example, using your information to administer our Services, including selecting tutor and student pairings, vendor management, troubleshooting, and data analytics.

  • To Contact You.  We may contact you with information about our Services or any other information you requested from us.  

  • To Better Understand Our Users and to Improve Our Services.  In the course of providing the Services, we or our service providers may analyze your device and usage data to better understand and serve our users, and to improve our website and/or Services.

  • To Protect the Services and the Rights of Users and Others. We may use your information as we believe is necessary or appropriate to protect, enforce, or defend the legal rights, privacy, safety, or property of Company.

  • Otherwise With Your Consent. We may otherwise use your information with your consent or at your direction.

How We Share Information We Collect

  • Service Providers.  We may share information with vendors providing services on our behalf, such as companies that host the content of our platforms.  

  • Your School.  We may share your information with your teacher and/or officials or representatives from your School for educational purposes.

  • Business Partners.  We may share your information with third party organizations with which we partner to provide educational services that you request. If such third party organizations collect information about you, that information is governed by their privacy policies.

  • Others When Required or Permitted by Law.  We may use and share your information in response to legal requests or process and when we believe it is necessary or appropriate to protect the legal rights, privacy, safety, or property of Company; to detect, suppress or prevent fraud; and to comply with applicable law and legal requests.

  • Other Parties in Connection With a Business TransactionWe may transfer information collected by Company in the event that we sell or transfer all or a portion of our assets to a third party in connection with a business transaction or bankruptcy.

  • Otherwise With Your Consent.  In addition to the sharing described in this Privacy Policy, we may share your information with third parties whenever you consent to or direct such sharing.

  • Aggregated Data.  We also may provide aggregated and anonymized information to third parties for usage, performance analytics and development and improvement of the Services.

  • Information You Share.  You may submit information directly to third parties, such as Zoom or Google, who provide functionality in connection with the Services.

Cookies

When you use our Services, we and our third party partners use cookies, pixel tags, local storage, local shared objects, and other similar technologies (collectively, “cookies”) to collect information about your browser or device.  By using our Services, you consent to our use of cookies and similar technologies.

The tracking technologies we use include:

  • Cookies.  Cookies are small files that are placed on your computer when you visit a website.  Cookies may be used to store a unique identification number tied to your computer or device so that you can be recognized as the same user across one or more browsing sessions, and across one or more sites.  Most browsers accept cookies automatically, but can be configured not to do so or to notify the user when a cookie is being sent.  If you wish to disable cookies, refer to your browser help menu.  If you choose to disable cookies, however, some of the functionality of our Services may be impaired.

  • Web beacons.  On certain web pages or in e-mails we send to you, we may utilize a technology called a “web beacon” (also known as an “action tag” or “clear GIF technology”).  We may use web beacons, for example, to help determine which email messages sent by us were opened and whether a message was acted upon.  Web beacons also help analyze the effectiveness of websites by measuring, for example, the number of visitors to a website or how many visitors clicked on key elements of a website.

  • Local Storage and Other Tracking Technologies.  We may also use other kinds of technologies, such as Local Shared Objects (also referred to as “Flash cookies”) and HTML5 local storage, in connection with the Services.  We also may use unique identifiers associated with your device, such as mobile ad identifiers.  These technologies are similar to the cookies discussed above in that they are stored on your device and can be used to store certain information about your activities and preferences.  However, these technologies may make use of different parts of your device from standard cookies, and so you might not be able to control them using standard browser tools and settings.  The method of disabling HTML5 local store will vary depending on your browser.  

Any or all of the above-described technologies may be used on our behalf by our service providers and such information may be stored, retained and shared with our service providers.

Do-Not-Track Signals and Similar Mechanisms.  Third parties may collect information about consumers’ online activities over time and across different websites, including when you use the Services.  Certain web browsers may offer “do-not-track” signals or other mechanisms to provide consumers the ability to exercise choice regarding this collection.  Currently, we do not respond to such signals.

Security

We have in place reasonable physical, electronic and managerial procedures to protect the information we collect.  However, no security system is impenetrable. We cannot guarantee the security of our Services, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet.  In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you of the security incident in accordance with applicable laws and regulations.

 

Other Important Information 

Updates to this Policy.  We may modify this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the “Effective Date” date above and post the new Privacy Policy.  Any changes to this Privacy Policy will become effective when we post the revised policy on our website.  We recommend that you review the Privacy Policy each time you visit the Services to stay informed of our privacy practices.

Student Privacy.  We may provide some of our Services through partnerships with Schools.  As part of these Services, we may receive personally identifiable information governed by the Family Educational Rights and Privacy Act or other educational privacy laws (“Student Records”).  

To the extent that the information we receive is covered by such laws, we work with our School partners to protect the privacy and security of Student Records in accordance with applicable laws.  We only use or disclose Student Records for the purpose of providing the Services to you, or for other authorized educational purposes at the direction of your School or with your consent.  We do not sell Student Records (except in the event of a business transaction, as described above) or use Student Records for targeted advertising purposes.

Children’s Privacy.   This site is not targeted towards children under the age of 13. If a parent or guardian is requesting a tutor for a student under eighteen years of age, the parent or guardian is required to fill out their child’s information and provide verifiable consent to Step Up Tutoring for the child’s participation.

 

Your Rights and Choices.  Depending on where you live, you may have certain rights under applicable laws, including:

  • The right to access your personal information; and

  • The right to request the deletion of certain personal information.

If you would like to access or delete your information, or otherwise exercise your rights, you or your authorized agent may contact us as set out in the Contact Us section below.  We will respond in a manner that is appropriate in light of relevant laws.  These rights are not absolute and we may ask you for information to verify your identity before responding to your request.

 

Linked Services.  We may link to sites operated by third parties, and may offer content, functionality and applications developed and maintained by the same.  This Privacy Policy does not apply to, and we are not responsible for, the privacy practices of third parties to which we may link or provide access.  You should consult the respective privacy policies of those third parties.
